Regulatory Advisory: Update: FCC Seeks Comment on Draft Filing Manual for Proposed Section 43.62 Annual Reports, Sets Comment Deadlines for Pending Rulemaking

As described in a July 5, 2011 Wiltshire & Grannis Regulatory Advisory, the International Bureau has prepared and now seeks comment on a draft Manual for Filing Section 43.62 Annual Reports ("Draft Filing Manual").  The Draft Filing Manual, however, goes beyond the scope of the Federal Communications Commission's First Report and Order ("Order") eliminating certain reporting obligations related to international telecommunications traffic.  The Draft Filing Manual sets forth proposed instructions on how to file the annual reports, including requirements for interconnected VoIP service providers.  This appears to assume that the Commission will adopt the proposed extension in the Further Notice of Proposed Rulemaking ("FNPRM") of the international reporting requirements to interconnected VoIP providers.  

The comment cycle on the FNPRM is currently open.  The Commission may ultimately adopt some or none of the proposed changes to the reporting requirements, or different changes altogether.  

The Commission has announced that it is now seeking comment on the Draft Filing Manual.  Interested parties may include their comments on the Draft Filing Manual along with their comments on the FNPRM.  The Order and FNPRM were published in the Federal Register on July 19, 2011.  Comments on both the FNPRM and the Draft Filing Manual are due on or before August 18, 2011.  Reply comments are due on or before September 2, 2011.
